Hueforia Terms and Services

These Terms and Services (“Terms”) govern your use of the Hueforia iOS application (“the App”) operated by Louis Wiyono, doing business as Whimsy Tales Art (“we,” “us,” or “the company”). By downloading, installing, or using the App, you agree to these Terms.

1. About the App

Hueforia is a creative companion for hobby colourists. It generates colour palettes, provides shading guidance, and matches digital colours to physical art media. It is designed to make colouring more enjoyable and accessible.

Hueforia is not an educational tool. The application is not intended to teach formal colour theory, nor should it be relied upon as instructional material for academic, professional, or certification purposes. The shading guidance, palette suggestions, and media matches are based on the creator’s personal artistic experiments — not on standardized curricula or universally accepted colour theory frameworks.

2. Experimental Nature of Colour Matching

Hueforia includes features that match digital colours to physical art media, such as marker sets and coloured pencils (collectively, “Media Matching”). These matches are provided for convenience and creative guidance only.

The following disclosures apply to Media Matching:

  • Media Matching is experimental and based on internal testing. It is not officially endorsed by, affiliated with, or validated by any art supply manufacturer or brand.
  • Due to variations in device screens, display calibration, ambient lighting, manufacturing tolerances, and other factors beyond the company’s control, we cannot and do not guarantee 100% colour accuracy between what you see on screen and your physical media.
  • Media matches should be treated as suggestions, not authoritative references. Testing on scrap paper before applying to your final work is recommended.
  • Brand names, marker codes, and product references are the property of their respective owners and are used descriptively only.

3. Proprietary Rights

The App — including its code, design, user interface, and all original content — is owned by the company and protected by copyright and other intellectual property laws.

The App’s colour generation methods, shading calculations, and palette construction algorithms are proprietary. These Terms do not grant you any right, title, or interest in the App’s underlying technology, methods, or trade secrets.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial colouring activities. You may not:

  • Copy, modify, reverse engineer, decompile, or attempt to extract the App’s source code or proprietary algorithms.
  • Use the App to build a competing product or service.
  • Resell, redistribute, or sublicense the App or any part of it.

4. User-Generated Content

If the App allows you to save, export, or share palettes, colour recipes, or other outputs, you retain ownership of those outputs. By using the App’s sharing features, you grant the company a non-exclusive, royalty-free license to display and distribute that content solely as necessary to provide the sharing functionality you requested.

5. Subscriptions and Purchases

Hueforia offers a free tier and optional paid upgrades. Free-tier features and limits are displayed within the App and may change from time to time. Upgrading is optional — the free tier remains available indefinitely.

Hueforia Pro — Auto-Renewable Subscriptions

Hueforia Pro unlocks the full set of premium features (unlimited palette generations, dynamic share-card templates, full bloom controls, marker matching, expanded saves, the Whimsy Tales discount perk, and more). Two subscription plans are available:

  • Hueforia Pro Monthly — $6.99 USD per month, auto-renewable, with a 7-day free trial for new subscribers.
  • Hueforia Pro Annual — $49.99 USD per year, auto-renewable, with a 7-day free trial for new subscribers.

Prices are charged in your local currency at the equivalent set by Apple’s App Store pricing tiers and may vary by territory. Prices include applicable taxes where required.

Auto-renewal disclosures:

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the renewal price disclosed at purchase.
  • You can manage and cancel your subscription at any time by going to your Apple ID account settings > Subscriptions on your device after purchase.
  • Cancelling during an active subscription period does not generate a refund for the remaining period — your Pro access continues until the end of the paid term.
  • Free trial: If your subscription includes a free trial, the trial period begins on the date of purchase. If you do not cancel at least 24 hours before the trial ends, your account will be automatically charged the regular subscription price. Any unused portion of a free trial is forfeited if you purchase a subscription before the trial ends.

Founding Colourist — One-Time Lifetime Purchase

The Founding Colourist tier is a one-time non-consumable in-app purchase that unlocks all Hueforia Pro features for the lifetime of the App, plus access to bonus downloadable content released over time.

  • Price: $89.99 USD, one-time payment.
  • No free trial. Apple does not support free trials on non-consumable in-app purchases.
  • No recurring charges. The Founding Colourist purchase is a single transaction with no renewal.
  • Family Sharing: Enabled. Eligible family members may share access subject to Apple’s Family Sharing rules.
  • Bonus content: Founding Colourist members receive access to bonus downloadable PDFs delivered via our secure Cloudflare Worker. Bonus content is delivered on a best-effort basis and may be updated, replaced, or expanded over time.

Restore Purchases

If you reinstall the App or switch to a new device using the same Apple ID, you can restore any previous Hueforia Pro subscription or Founding Colourist purchase from within the App’s paywall screen at no additional cost.

Refunds

All purchases are processed by Apple. Refund requests must be made directly to Apple through your Apple ID account > Report a Problem page. The company does not have the ability to issue refunds for App Store purchases.

Price Changes

The company may adjust subscription prices from time to time. Any change to the price of an existing subscription will be disclosed in advance and, where required by Apple, will require your explicit consent before taking effect. If you do not consent, your subscription will continue at the previous price until the end of the current period and will not renew.

6. Disclaimers and Limitations of Liability

The App is provided “as is” and “as available.” To the fullest extent permitted by applicable law:

  • No warranties, express or implied, are made regarding the App’s accuracy, reliability, or fitness for any particular purpose.
  • The company is not liable for any artistic outcomes, dissatisfaction with colouring results, or creative decisions made based on the App’s suggestions.
  • The company is not liable for colour matching inaccuracies caused by screen calibration differences, manufacturing variations in physical media, or any other factors described in Section 2.
  • The company is not liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the App.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In those jurisdictions, liability is limited to the maximum extent permitted by law.

7. Third-Party Services

The App integrates with third-party services, including analytics providers, email services, beta testing platforms, subscription management, and content delivery providers. Your use of these services is subject to their respective terms and privacy policies. The company is not responsible for the content, functionality, or practices of third-party services. A full list of third-party services and the data shared with each is provided in our Privacy Policy.

8. Termination

The company reserves the right to suspend or terminate your access to the App at any time, with or without cause, including if you violate these Terms. Upon termination, your right to use the App ceases immediately. Termination does not entitle you to a refund of any subscription fees or one-time purchases — refund requests must be directed to Apple as described in Section 5.

9. Changes to These Terms

The company may update these Terms from time to time. Material changes will be communicated through the App or via email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of British Columbia.
